Terms of Sale

All products sold on the Site (the "Products") are supplied strictly for in-vitro laboratory research and academic study. Products are not drugs, dietary supplements, cosmetics, food, or medical devices. They are not intended for human or veterinary consumption and must not be administered to, injected into, applied to, or ingested by any human or animal. Buyer agrees not to resell, redistribute, or transfer Products for any such use.

By placing an order Buyer represents and warrants that Buyer is at least eighteen (18) years of age, has the legal capacity to enter into these Terms, is a qualified researcher or purchasing on behalf of a qualified research entity, and will handle Products in compliance with all applicable federal, state, local, and institutional laws, rules, and policies. We may refuse or cancel any order at our sole discretion.

PRODUCTS ARE SOLD "AS IS" AND "AS AVAILABLE" WITH ALL FAULTS. TO THE FULLEST EXTENT PERMITTED BY LAW, PEAK PEPTIDE SOLUTIONS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. Our sole representation is that each released lot meets the specifications set out on the accompanying Certificate of Analysis (COA).

TO THE FULLEST EXTENT PERMITTED BY LAW, PEAK PEPTIDE SOLUTIONS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR BUSINESS, ARISING OUT OF OR RELATING TO THESE TERMS OR THE PRODUCTS, WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Our aggregate liability for any claim arising out of or relating to a Product shall not exceed the amount Buyer paid for that Product.

Buyer agrees to defend, indemnify, and hold harmless Peak Peptide Solutions and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) Buyer's use, storage, handling, or disposal of the Products; (b) any administration of a Product to any human or animal; (c) Buyer's breach of these Terms; or (d) Buyer's violation of any applicable law or regulation.

Buyer is solely responsible for compliance with all import, export, controlled-substance, customs, tax, and institutional-review requirements applicable to the Products. Buyer represents that Buyer is not a person or entity restricted under U.S. export controls or economic sanctions.

Any customer review, testimonial, comment, image, or other content Buyer submits to the Site must be truthful, must relate solely to the research characteristics of a Product, and must not imply, describe, or endorse human or veterinary use, therapeutic effect, dosing, or medical outcome. Content that violates this section is a breach of these Terms and may be edited or removed without notice, and repeat violations may result in account termination.

All prices are in U.S. dollars and subject to change without notice until the order is placed. Orders ship after payment confirmation from a U.S. facility. Title and risk of loss pass to Buyer on delivery to the carrier. Orders are non-refundable once shipped except where a lot demonstrably fails to meet the specifications on its COA.

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. If any provision is held unenforceable, the remaining provisions remain in full force and effect. These Terms, together with the Privacy Policy and Disclaimers, constitute the entire agreement between Buyer and us concerning the Products.
